Welcome to Quiet Harbour™ — a mindfulness and music app designed for simplicity, presence, and peace. These Terms of Service (“Terms”) govern your use of the Quiet Harbour app and website operated by Quiet Harbour Inc. (“we,” “us,” or “our”).

By using Quiet Harbour, you agree to be bound by these Terms. If you do not agree, please do not use the app.

1. Eligibility and Use of the App

You may use Quiet Harbour only for personal, non-commercial purposes. The app is not intended for use by individuals under the age of 13. Quiet Harbour is intended to provide calming content, including music, sound layering, and guided sessions. It is not a substitute for medical advice, diagnosis, or treatment.

2. No Sign-Up or Accounts

Quiet Harbour does not require a user account or login. We do not collect personally identifiable information. All data (such as favorites) is stored locally and encrypted on your device.

3. Health App Integration (Optional)

If you choose to enable Apple HealthKit integration, Quiet Harbour may log completed mindfulness sessions to the “Mindful Minutes” category in your Health app. This integration is optional, requires your explicit consent, and all data remains on your device.

- We only write to the Mindful Minutes category.

- We do not read, store, or transmit any health data.

- All HealthKit usage complies with Apple’s guidelines.

4. Intellectual Property

All content within the Quiet Harbour app and website — including but not limited to scripts, audio recordings, user interface elements, design assets, names, icons, and trademarks — is the exclusive property of Quiet Harbour Inc., unless otherwise specified. This material is protected under copyright, trademark, and other applicable intellectual property laws.

All rights are reserved. Any unauthorized use, reproduction, distribution, or modification of any part of Quiet Harbour is strictly prohibited.

Music content is provided under a commercial use license from Zenmix.io. All guided session scripts and voiceovers are original creations developed for Quiet Harbour and may not be copied, adapted, or used in any other context without prior written permission.

5. Limited License

We grant you a limited, revocable, non-transferable license to use Quiet Harbour on your personal iOS or compatible device in accordance with these Terms. We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice.

6. Offline Access

Quiet Harbour allows offline playback of favorited music tracks. These files are stored securely on your device and are not shared or synced with us.

7. Prohibited Use

You agree not to:

- Use the app in any unlawful manner

- Reverse engineer or tamper with the app

- Distribute or scrape content from the app

- Use Quiet Harbour for commercial, broadcast, or resale purposes

- Circumvent any security features or licensing controls

8. Third-Party Services

Some features of the app (e.g., cloud content delivery via Cloudflare R2, optional logging to the Apple Health app through HealthKit) rely on third-party services. Your use of these features is also subject to the respective terms and privacy policies of those providers.

9. Disclaimer

Quiet Harbour is provided “as is,” without warranties of any kind, express or implied. We do not guarantee uninterrupted service or error-free operation, nor do we make claims about health outcomes from using the app.

10. Limitation of Liability

To the fullest extent permitted by law, Quiet Harbour Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to your use of the app.

11. App Store Compliance

Your use of Quiet Harbour through any app store platform (including but not limited to Apple App Store, Google Play, Huawei AppGallery, Amazon Appstore) is also subject to that platform’s respective terms of service and privacy policy.

12. Modifications

We may update these Terms at any time. If we make significant changes, we will post an update in the app or on our website. Continued use of the app after such updates constitutes your acceptance of the revised Terms.

13. Wellness & Medical Disclaimer

Quiet Harbour™ is a mindfulness and music app. It is not a medical device, therapy service, or mental health treatment tool. The app is intended for general wellness and emotional support only.

If you are experiencing distress, illness, or a mental health crisis, please consult a licensed healthcare provider or mental health professional. Quiet Harbour does not diagnose, treat, or prevent any medical condition.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada.
